CANADA WORK PERMIT VISA

 

Eligible individuals from across the borders can work on Canadian soil for a stipulated amount of time by acquiring the Canadian Work Permit or Work Visa.

DETAILS REGARDING THE WORK PERMIT VISA

ELIGIBILITY FOR A CANADIAN WORK PERMIT VISA:

1.provide assurance that you will not overstay your welcome and will move out of Canada as your work permit reaches its expiry

3.    Possess a clean criminal record devoid of any dubious activity. This claim is to be supported with a police clearance certificate.

That you pose no imminent threat or danger to Canada’s federal or local security

No medical complications and must partake in a medical exam if requested

4.    Have no intentions to work for an employer blacklisted or deemed ineligible by the Canadian government

5.    Have no intentions to work for an employer who offers or engages in erotica that includes dances, escort services, strip teasing or erotic massages

6.    Must be cooperative and be willing to provide any other relevant documents demanded by officers to qualify and ascertain your entry into Canada

Different types of work permits:

There are two types of work permits awarded by Canadian officers and authorities

1.Employer-specific work permit

The applicant is allowed to work under only the specified employer during their stay in Canada.

2.An open work permits

An open work permit allows the employee to work for any employer of their choice. This visa is not inherently job-specific which allows the applicants to discount the Labour Market Impact Assessment (LMIA) or an offer letter from an employer who has paid the nominal compliance fee. Posts can be assumed for jobs from any sector except for those companies that do not comply with foreign labour requirements or those involved in erotica services.

However, the open work permit can be subjected to certain restrictions or conditions which can include:

●     Duration of billable working hours

Individuals in possession of the following can further apply for an OPW

●     Temporary Work Permits for spouses

●     Post-Graduation Work Permit

●     Temporary Resident Permit

●     World Youth Program Permit

●     Regular Open Work Permit

●     Bridging Open Work Permit

Conditions that apply for the open work permit:

●     Proof of financial resources that can support yours and your family’s lifestyle in Canada during the work permit validity

●     Proof of absence of a criminal record

●     Proof of good health and no impending diseases or health complications

●     Willingness to abide to the conditions of your work permit even if you are granted only a restricted work permit

●     Meet eligibility conditions such as language proficiency, biometric data, and required insurances

DEPENDENT WORK VISA

The government of Canada allows immigration of family or next of kin for individuals who fall into the listed conditions

You may be entitled to move with your immediate family consisting of your spouse and children if you are presented with a job offer from a Canadian employer.

Your children will be open to pursue their education at Canadian educational institutions without separate study or educational permits. Your spouse will be eligible to apply for an OPW so that they can work and earn on Canadian soil.

Parents and grandparents must be supported by permanent residents or Canadian citizens who will accompany the member for a span from three to ten years of time.

CONDITIONS FOR A DEPENDENT VISA

Family members eligible for Canada’s Dependent Work Permit are:

●     Spouse, spousal or any common-law partners over the age of sixteen

●     Parents and grandparents of the applicant

●     Financially or inherently dependent children, including adopted or fostered children

●     Minors or children under the age of eighteen whom you wish to adopt

●     Siblings, nephews and nieces, children under the age of eighteen, orphans and unmarried

Children are required to meet the following conditions:

●     Children younger than the age of 22, unmarried or without a common-law partner

●     Children who have spouses before the age of twenty-two and look to parents for support

●     Physically or mentally impaired children who require familial support

DEPENDENT VISA APPLICATION PREREQUISITES

You will need to add the following to sponsor your family members for A Dependent Visa for Canada

●       Recorded evidence of your financial flux and cash flow over the past year as proof of financial stability

If you are supporting your child via the Canadian Dependent Visa, they must comply but the following conditions

●        Must be a minor under the age of twenty-two.

●       In the light of physical or mental impairment, the child must have doctor’s certificates to prove the same.

●       Only biological or legally adopted minors will be considered children

●       Birth certificates or Adoption papers need to be submitted as proof of parent/guardian

●       Absence of criminal record or health issues is imperative

Absolutely. IELTS is a compulsory examination for anyone applying for a Canada PR Visa.

An overseas employee applying for a Canada Work Visa must provide all the required documents requested by the employer. They will also need these documents:

Your study permit must be given to you within 15 to 20 days after the application. But the student must know that he/she cannot enter the country on the basis of the study permit and will be requiring a legal either visitor visa or student visa accordingly.

The visa requires a bare minimum overall score of 6.5 bands with a minimum of 6.0 score in the Academic test conducted for the IELTS

Canada Work Visa is granted to an overseas individual who intends to work on Canadian soil. They must refrain from being Canada PR Visa holders or citizens. This is imperative for working in Canada irrespective of whether the employer is living in Canada or not.

Canada Work Permit application from India requires the LMO – Labour Market Opinion, a verification from the labour market in Canada. The application for a Work Visa can be submitted only after getting a verified, positive LMO.

The Canada Work Visa process happens in two stages. In the first stage, the employer in Canada must apply approval from the Government of Canada to hire overseas workers. In the second step, the employee must apply for obtaining the Work Visa after getting permission under the mentioned employer

    The application is verified to ensure it has all the necessary documents. Incomplete applications are returned.

      You may need to undergo a medical exam by a certified hospital which can extend processing to three months to the processing time.

      Biometrics might have to submitted as well with the application

      An officer will verify the credentials of the employer who has requested to hired you

      An officer will check if you qualify for the work permit in question

      After approval of your application you will get a letter granting you permission to work on Canadian soil

      After submitting this letter, you will receive your Work Permit on arrival in Canada

    It will have details pertaining to the type of work you will do, mention the employer and the place and duration of your work with other relevant details.

You can apply for a spouse dependent work permit as soon as you receive your study/work permit in Canada. You will get them approximately around 15 days from the day of arrival.

With an open work permit the individual can work for any employer in Canada except for those companies that do not comply with labour requirements or are involved in services like escort services, erotic massage or exotic dancing.
